Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.
-from the document.
that sums it up.
there is no rational basis. this fails the rational basis clause. the President CANNOT just go around making any laws s/he wants and CLAIM DANGER. there must BE REAL danger. this goes back to the Japanese in WWII when the Supreme Court ruled it was OK to intern the Japanese but only for this case only they were specific that the President could not make similar decisions going forward based on this ruling.
there is no real danger here. no one from any of those nations has committed a capital offense since 2001. it doesn't exist therefore the President does not have standing to make such a law, not to mention he is making it against a religion which is prohibited.
Further, the Haitians fell under legitimate reasons as supported by this conclusion from the document.
"In no case to date, though, has the Executive purported to take certain types of action, such as barring all aliens from entering the United States for an extended period of time or explicitly distinguishing between categories of aliens based on their religion. Any such restrictions could potentially be seen to raise legal issues that were not raised by prior exclusions."
thanks for the pages, I appreciate that. No looking to argue but debate and I think we are doing a good job there.
I also think the explanations are very clear as to why Trump is struck down and the others were not, because they were not the same at all at all, at all.
Thanks again for posting the facts. I think that is good for all of us.
2015, Jan. 6 – Obama
Executive Order 13687, 80 Fed. Reg. 819
Suspending the entry into the United States, as immigrants or nonimmigrants, of aliens with specified connections to North Korea (e.g., officials of the North Korean government or the Workers’ Party of Korea)
ALL of the Obama orders I read had one thing in common.
the persons excluded DID something wrong.
these are 100% legal. How could anyone try to suggest Trumps order is anywhere near the same. c'mon now....that is just silly. You have to see the differences no? they are very stark.
